Bubbles Estates (Property Lettings) Terms and Conditions for Landlords Placing Properties with Bubbles Estates for Rental. (Bubbles Estates is a trading name of Shaun Murphy) Our Letting and Management responsibilities as Agents, along with your responsibilities as Landlord ……and our terms below: - 1. Our Agents fee is 10% of all rents collected. 2. We reserve the right to add VAT to the above fee should I ever become registered for VAT in the future. Bubbles Estates will give 3 months notice to this effect. 3. We have no "sign up" costs for Landlords or Tenants; apart from that we do charge potential Tenants for credit checks that we make on them. 4. No let, then no fee to Landlords. 5. Free advice will be given to you on the rents you can expect, and on other "setting up" matters, including: - Tax, insurance, repairs and your legal requirements as a Landlord. You decide with guidance. 6. We (the Agents) will promote the property as necessary in order to find a suitable Tenant. This normally (unless agreed) involves local press and Internet advertising. The cost of this promotion is included in the management fee, which is 10% of all rents collected. 7. You (the Landlord) will supply a gas safety certificate in respect of the property. A CORGI registered contractor must issue this. 8. You (the Landlord) will also supply an electrical compliance certificate in respect of the property under the Electrical Equipment Safety regulations 1994. This must be supplied by a qualified electrician. 9. You (the Landlord) are also responsible by law to provide tenants with a Energy Performance certificate for your property . 10. You (the Landlord) will ensure that all upholstered furniture in the property complies with the Fire and Furnishings Regulations 1988 and that the compliance labels are attached to the furniture. 11. We will arrange appointments to view and will attend such appointments and vet potential Tenants personally. 12. If a Tenant is deemed suitable, then a deposit of at least one months rent will be secured. 13. Potential Tenants will be credit checked and references taken. 14. If a potential Tenant is not deemed suitable then no Tenancy will be permitted. 15. If a Tenant is deemed suitable, then a deposit of at least one months rent will have already been secured. This will be held on deposit with the DPS. Full refunds will be given to Tenants who hand back the property at the end of their tenancy in a "fair condition", allowing for reasonable wear and tear. 16. We will draw up a contract in common law, using an Assured Shorthold Tenancy Agreement (ASTA). This guarantees the tenant possession of the property for six months, unless there is a breach of the Tenancy agreement under the terms of the contract. 17. Should a Tenant be in breach of the Tenancy agreement then we will either: - Immediately serve a two months notice to vacate paper on the Tenant, or if the breach is severe it may be necessary to take Legal action. If it does become necessary to instruct Solicitors then you, (the Landlord) will be responsible for instructing your Solicitor, and you, (the Landlord) will be responsible for all your Solicitors fees and other fees incurred in this matter. 18. We reserve the right to charge a fee of up to £150 per day to attend court on your behalf. 19. At least 2 months prior to the end of the ASTA, a notice will be served on the Tenant to terminate the Tenancy, unless a new agreement is agreed. 20. Prior to the Tenant moving in a full inventory will be taken, along with a note of the condition of property. 21. The gas and electricity meters will be read, and the service providers or you (the Landlord) will be informed of the new Tenants details along with the old readings. Council tax and Water Rate departments or you (the Landlord) will also be informed of the new Tenants details. 22. We are not responsible for re directing of mail. 23. Rent will be collected on a monthly basis, in person by us as Agent (unless otherwise agreed with the Tenant) on the due payment date written on the contract. Monies collected less my fee of 10% will then be delivered or posted to the Landlord within 10 days. 24. If we have incurred any "extraordinary" expenses, which have been agreed with you then you give us permission to deduct these from rents collected. 25. Regular inspections will take place of the property, both inside and outside. 26. Any problems or repairs found needing doing on the property at any time would be reported to the Landlord immediately. It is your responsibility to pay for, and to effect repairs on the property as soon as possible. As Landlord you have a duty to do this. 27. If you have provided us with the names of approved contractors in your absence, then we will make every reasonable effort to contact them to undertake any needed repairs. 28. About a week before the end of the Tenancy a "first" inspection will take place. This is to encourage cleaning of the property. 29. On the day of leaving a final inspection will take place. This inspection determines the amount of deposit refund to the Tenant. 30. During any periods when a Tenant does not occupy the property monthly checks on the property will occur. 31. In periods of very cold weather weekly checks will occur. 32. Either party must give at least 3 months written notice to terminate this contract; this is to make sure that as Agent I have time to issue a notice to repossess the property to the Tenant and thus terminate my obligations under this contract prior to the Tenant leaving. 33. If the property is sold to a Tenant or anyone associated with the Tenant or any other persons introduced to the property by Shaun Murphy or Bubbles Estates as Agents to the property, then the Landlord agrees to pay a commission of three quarters of one percent of the contract price. 34. Shaun Murphy (Bubbles Estates) may add or delete any of these terms and conditions by giving the Landlord 3 months written notice. 35. The Landlord (owner) of the property agree to indemnify the Agent (Shaun Murphy / Bubbles Estates) against any damage or liability, costs or expenses incurred by the agent during the time the Agent is, or was, acting on the Landlords behalf, along with indemnifying the cost of any work that was carried out by the Agent to ensure that the property and its contents do comply with the Landlords obligations to the Tenant.
